Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following Terms and Conditions of Use (“Terms”), which together with our Privacy Policy, govern dronefishing.co.nz’s relationship with you in relation to your use of this website.

By purchasing any product or service from this website, you have deemed to have read, understand and agree to all of the information provided below, including stipulations and processes, and you will also agree to read and adhere to all information contained found in the product manuals in the support section of this website (found elsewhere).

“Us”, “Our” and “We/we”, refers to dronefishing.co.nz including its directors, employees, contractors and affiliates

“Website” means dronefishing.co.nz

“Drone Fishing NZ” and “drone fishing.co.nz” refers to the trading entity “Drone Fishing New Zealand”

“You/you” and “your” refers to you as purchaser of our products, or individual using our website

DELIVERY OF PRODUCTS

Our products may be delivered by local post and/or reputable courier companies. Deliveries are processed promptly on receipt of full payment into our bank account. Delivery normally takes between 2-3 days from dispatch from our warehouse depending on your delivery location in NZ, although from time to time this might be longer as a result of courier delays which is out of our control. From time to time there are also delays relating to incoming supplier shipments of product, but please understand that these delays are out of our control, but we do our best to inform our customers in these situations.  Damaged or lost orders should first be addressed and resolved with the Post Office or courier company directly. Replacement of any such lost or damaged goods is made at the discretion of dronefishing.co.nz.

REFUNDS AND RETURNS

We do not offer a refund if you change your mind. At our discretion we may allow return of the product in exchange for another of the same value. It must be unopened and in the original packaging accompanied by your receipt. You must ensure we receive the products and please note that return shipping is at your cost for any exchange. Once we receive the returned products, we will check the product to ensure packaging is in original condition and product hasn’t been opened. We cannot offer an exchange or refund for any opened or used products.  If we have made an error on your order, we will reimburse you for any return shipping costs.

We handle all returns and process repairs, replacements, or refunds in accordance with Consumer Law. Our liability for products that are found to be under warranty is limited to: supplying you the repaired products; or the replacement of the products if repair is not applicable .  Dronefishing.co.nz is also at the mercy of the service agents of each manufacturer we work with.  We will do our best to liaise on behalf of our customers with the service agents to get any service work completed in a timely manner.

WARRANTY INFORMATION

New Drones normally come with a 12 month warranty from purchase date (pleases see further details below), that covers manufacturer issues or product faults.  However this does not cover wear and tear, mis-use of product, or other issues or crashes related to customer use (including damage to any third parties).
Note that the product with the reported problem MUST to be first returned to the authorised repair agent for each brand (at the customers cost) to be reviewed by technicians before the manufacturer is able to make final decision about the issue. No warranty claim can be evaluated if the product is not first returned. Only the authorised New Zealand manufacturer service agent can provide legitimate inspection and analysis of any product returned.
Refurbished drone bodies come with a 6 month warranty, and all new batteries come with a 3 month warranty. All other new products and parts come with a 3 month warranty. See further details below.
Warranty and liability is limited to the product purchased, and not any additional losses incurred, including any third party losses or damage that may be incurred.

LIMITED WARRANTY DISCLAIMER

Please remember to retain the purchase receipt as you’ll be asked to present the receipt in any given cases.

How long does the warranty last?

  • New Drones (GPS): 12 months warranty.  Propellers, Landing gear carry a 1 month warranty.  Supplied batteries carry a 3 month warranty.
  • New Accessories: 3 months warranty.
  • New Batteries: 3 Month warranty.
  • Refurbished, ex Demo, Second hand, Non packaged Drones & supplied accessories: 6 month on GPS Drone body, No warranty on drone battery (and remote battery if applicable) and propellers, 1 month on any other accessories and ad-ons including, cameras, fishing release systems, remote control, etc.  Note that for refurbished, ex demo and second hand drones, our policy is to repair the drone or any accessories that are found to have a manufacturing fault.  Refunds or replacement for a pre-owned or ex demo drone or accessories is not applicable.  Wear and tear, user caused faults (including water damage and lack of maintenance), or failure to follow the product manual correctly (see the support section) are not covered under warranty).
  • A replacement product (or part) or repaired product assumes the remaining warranty period of original purchase date the initial product or accessory.

What does the limited warranty cover?

  • The limited warranty covers any defects in material or workmanship under normal use during the warranty period.
  • If the product is deemed to be under warranty by the manufacturer’s service agent, the manufacturer or manufacturer’s agent will repair or replace at their discretion (Refurbished product can only be repaired)

What does the limited warranty NOT cover?

The limited warranty does not cover any problem that is caused by:

  • Conditions, malfunctions or damage not resulting from defects in material or workmanship.
  • Damage to the product resulting from negligence, mis use, wear & tear, water or salt intrusion into the drone, corrosion on any external parts, failure to clean and maintain the drone regularly.
  • Subsequent Damage or failure of a product as a result of a previous crash where the drone was not first returned to the authorised repair agent for inspection.
  • Cleaning of the product where there is found to be sand, corrosion or other contaminants present.
  • Damage to the product (or other people or property) caused by lack of adequate training or skill level when using the product.  It is highly recommended to seek professional training before using any drone product.
  • In cases where the product is not first returned to the authorised repair technician for initial inspection, there will be no warranty.
  • Damage to a product resulting from unauthorized modification of the product.
  • Theft or loss of the product.
  • Using the product outside of the manufacturer’s specifications or instructions (for example overloading the drone, using the drone in excessive weather environments, not being sufficiently trained while flying the drone, not following nz laws and regulations, or many others)
  • Damage caused by External interference from external sources including (but not limited to): Microwave Interference, Radio Interference, Radar Interference, WIFI Interference, Magnetic Interference, Electrical and Atmospheric Interference, Issues around GPS Satellite reception.
  • The Warranty does not cover return shipping to our service centre to for them to investigate the issue further.
  • It also doesn’t cover if you change your mind about your purchase.  We are obliged to repair or replace in relation to any manufacturer defects but there is no obligation on Drone Fishing NZ if you have changed your mind.
  • Mis-use of the product or failing to follow the instructions or information in the product manual or any information videos related to the product. (Please see copies of the correct NZ product manuals in the support section of this website, and these manuals are the only ones that should be referred to under ANY circumstances.).

Rechargeable Batteries

Note: There is three month limited warranty on sales of new rechargeable batteries and no warranty on second hand, refurbished batteries. If you claim the battery to be faulty within that time period, the battery will be inspected and if any user abuse, improper maintenance, or mis-use is found on the battery, the claim will be rejected.

The warranty on any rechargeable batteries is subject to the user following all safety and precautions provided (please see the support section of this website for more information regarding the product you purchased).  FAILURE TO FOLLOW: THE CORRECT INFORMATION REGARDING THE BATTERY MAINTENANCE, USE & CHARGING OF THE BATTERY, USE OF THE CHARGER, AND ANY RECOMMENDATIONS,  IS STRICTLY FORBIDDEN AS THIS IS DANGEROUS AND CAN CREATE A FIRE RISK.  DRONE FISHING NZ TAKES NO RESPONSIBILITY UNDER THESE CONDITIONS.  The warranty does not cover overcharging or over discharging of batteries (which then leads to battery issues or non working batteries).

IMPORTANT NOTE : NEVER leave batteries unattended while they are charging.  Our recommendation is to always charge and store batteries in a fireproof bag or container. Do not leave the battery charger on overnight, and turn off/remove power to chargers before going to bed.  Only use the correct original charger & cables supplied by the manufacturer and follow all reasonable standards while charging (ie. no double plugs or loose connections, direct connections to power outlets rather than multi-plugs).  Batteries should not be stored for more than a few days on full charge and batteries should not be fully drained out of charge as the battery can be permanently damaged in both cases.

Please note that all products and accessories sold on this website are not toys, and should not be operated by children at any time (under the age of 18 years).  Many products have hazardous moving parts which can be dangerous.

If you change your mind about a purchase

Please note that if you change your mind about a purchase you have made through our store, then it is upto the discretion of the Drone Fishing NZ Staff whether to accept the product back.  We will also only be able to provide replacement with a different product under the following conditions:
– The product & packaging is in brand new condition and resealable condition and the product is working correctly (as deemed by our service staff).
– All Packaging and other accessories supplied with the product at time of sale have been returned and are in brand new condition.
– It is within 7 days of the purchase date.

Please be aware that Drone Fishing NZ or related entities take no responsibility for the the use or mis-use of our products by the customer, or any resulting damage that may occur.  The customer needs to use the product or fly their drone is a safe manner at all times, reading all documentation supplied with the product, and obeying all laws before use or flight.  It is also highly advisable that the customer reads and understands all laws are regulations both national and local, including the CAA Regulations.  The CAA Website is provided here for more information: https://www.aviation.govt.nz/

LIMITATION OF LIABILITY

It is an essential pre-condition to you using our website that you agree and accept that dronefishing.co.nz is not legally responsible for any direct, indirect, consequential or incidental loss, injury or damage you might suffer related to your use of the website, whether from errors or from omissions in our information, any products or services we offer or from any other use of the website. Your use of any information, materials or services on or through this website is entirely at your own risk, for which we shall not be liable.

It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

To the extent we are unable to exclude liability; our total liability for loss or damage you suffer or incur from our products and website services is limited to us re-supplying the Product or Services to you, or, at our option, us refunding to you the amount you have paid us for the Products or Services to which your claim relates.

Legislation may confer certain rights, warranties and guarantees and remedies relating to the provision of the products and website services which cannot be excluded, restricted or modified, including but not limited to Consumer Law. At no time are these statutory rights sought to be excluded.

We use the information we collect about you to maximize the services that we provide to you. dronefishing.co.nz respects the privacy and confidentiality of the information provided by you. AMENDMENT OF TERMS AND WEBSITE CONTENT

We reserve the right to change, modify, add or remove portions of these terms, any content or appearance of the website at any time without notice. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and dronefishing.co.nz’s rights and obligations to each other.

USE OF WEBSITE AND SERVICES

We make no warranty that the website services will meet your requirements or be available on an uninterrupted, secure or error-free basis. We will do our best endeavors to ensure the website is always available and virus free but from time-to-time, and in some instances, this may not be the case as it may be out of our immediate control. We will notify you if the website becomes unavailable for any lengthy and unusual time period.

All information provided in the article section of this website is provided at no charge to the public.  It often contains editorial and opinion of the writers.  While we make every effort to ensure all information within these articles is accurate at the time of writing, from time to time there may be errors. Any information contained in these articles should be regarded as editorial and opinion and dronefishing.co.nz provides no warranty or guarantee around the use of this information by its readers.

You agree and acknowledge that the website uses third party vendors and hosting partners to provide the necessary software, hardware, service and storage.

All custom graphics, icons, logos and service names are registered trademarks, copyright, trade or service marks of dronefishing.co.nz. Any redistribution or reproduction of part or all of the contents in any form is prohibited.

All other trademarks or service marks within this website are the property of their respective owners. Nothing in these Terms grants you any right to use any trademark, service mark, logo, and/or our name.

You are solely responsible for obtaining written permission before re-using any copyrighted material that is available on this website. Any unauthorized use of the materials appearing on this website may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

We expressly reserve all copyright and trademark in our website and in all documents and information on our website and reserves the right to take action against you if you breach any of these terms.

WHOLE AGREEMENT

These Terms represent the whole agreement between you and dronefishing.co.nz concerning your use and access to dronefishing.co.nz’s website and your use and access to the products, services and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.

EXCLUSION OF UNENFORCEABLE TERMS

Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

JURISDICTION

This agreement and this website are subject to the laws of New Zealand. If there is a dispute between you and dronefishing.co.nz that results in litigation then you must submit to the jurisdiction of the courts of New Zealand.
